Hermann Heinrich Fitting
Heinrich Hermann Fitting was born on the 27th of August 1831 in Mauchenheim (Rheinpfalz) and died on the 3rd of December 1918 in Halle (Saale), studied law in Würzburg, Heidelberg and Erlangen. After gaining his doctorate (1852) and habilitation (1856), Fitting became an associate professor of Roman law in Basel in 1857 and a full professor in 1858. He then followed a call to Halle (Saale), where he taught Roman law from 1862-1902 and later mainly civil procedure and bankruptcy law.
Fitting’s academic life’s work comprises two areas: In the field of knowledge of applicable law, he made an impact primarily through his textbook on civil procedure (1878, 13th ed. 1908), which was also widely used in lay circles thanks to its excellent presentation of the brittle subject matter. His literary inclinations, however, centred on Roman legal history, in particular the history of literature and the development of jurisprudence in Italy and France in the early Middle Ages.
Fitting affirmed the continuous coherence of jurisprudence in the area of the former Western Roman Empire in the period between the codification of Emperor Justitian (early 6th century) and the emergence of the Bolognese school of glossators (late 10th century) and sought to substantiate this with the help of exemplary source publications. A controversy arose between him and the legal historian Max Conrat [Cohn (1848-1911)], who vigorously disputed his theses, the outcome of which has not yet been decided. Notwithstanding the above, Fittings’s significance lies in seeking answers to this important question and thus having inspired extensive research.
In 1923, the estate was donated to the ULB’s manuscript collection as a gift (cf. accession journal 1923 G 9469-9481) and received the shelfmarks Yi 1 and Yi 3. They also list him in the directory “Scholars’ and Writers’ Estates in the Libraries of the German Democratic Republic”, Part I, Berlin 1959, on p. 32, no. 175.
The estate contains letters from the years 1889-1916, 2 hand copies, copies of legal texts from French and Spanish archives, negatives and photocopies as well as excerpts.
